terms of service.

last updated · 2026-05-02

these are the terms for using vibezilla.games. they exist so that everyone — readers, players, creators, and us — knows what to expect. we tried to write them like a person would. the legal bits are still legal bits, and they matter.

the short version.

  • browse and play freely. we don't warranty anything; play at your own risk.
  • if you submit a game or content, you keep ownership but give us a license to feature it.
  • we curate; we accept, edit, or reject at our sole discretion.
  • no spam, no scraping, no malware, no NFT/crypto stunts, no impersonation.
  • third-party games we embed or link to are run by their creators — not us.
  • liability is capped; the service is provided "as is" to the maximum extent law permits.

the rest of this page is the longer version of the same thing.

1. agreement.

these Terms of Service ("Terms") are a binding agreement between you ("you", "your") and vibezilla.games ("vibezilla", "we", "us", "our"), operated as a sole venture by Ori Iscovici (isco-tec), based in Israel. they cover everything at vibezilla.games and any subdomain we operate (collectively, the "Service").

by accessing or using the Service, you confirm you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. if you don't agree, please don't use the Service.

these Terms include important provisions limiting our liability (Section 13), disclaiming warranties (Section 12), and requiring you to indemnify us (Section 14). please read them carefully.

2. what vibezilla is.

vibezilla is a curated arcade and editorial publication for small browser games. we hand-pick games, write about them, embed them or link to them, and sometimes group them into themed collections. we do not develop most of the games on the site; they are made by their creators, who retain ownership.

the Service may include: a homepage feed, the arcade (/games), creator profiles (/creators), themed collections (/collections), editorial posts (/posts), a newsletter, the submission surface (/submit), accounts and authenticated features (/sign-in), and any other section we ship over time.

we are not a marketplace. we do not host most of the games we feature — we link to or embed them. third-party games are governed by their creators' own terms (see Section 9).

3. eligibility.

you must be at least 16 years old, or the minimum age of digital consent in your jurisdiction (whichever is higher), to create an account, submit a game, or otherwise contribute content. if you are using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

you must not be barred from using the Service under applicable law, including export-control or sanctions laws, and your account must not have been previously suspended or terminated for breach.

4. accounts.

anonymous browsing and play do not require an account. an account is required for the higher-friction features (submitting a game, saving favorites, future community surfaces). if you choose to sign in — via Google OAuth or email magic link, both handled by Supabase — you agree to:

  • provide accurate information and keep it current;
  • keep the email address tied to your account secure (since the magic-link sign-in surface relies on it);
  • not impersonate any person or misrepresent your affiliation;
  • not use automation to create or operate accounts at scale;
  • maintain only one account per person, except where we expressly authorize otherwise (e.g. a maintainer and a separate test account);
  • accept responsibility for everything done under your account.

you can close your account at any time from your account settings or by emailing hi [at] vibezilla [dot] games . we may suspend or terminate accounts that breach these Terms, threaten the security of the Service, or are inactive for an extended period — see Section 14.

5. user-submitted content.

you ("Submitter") may submit content to vibezilla — game pitches, creator profiles, bios, links, images (avatar, game thumbnail), and any future contributions such as comments — through /submit, through your account, or through any other channel we provide ("User Content").

5.1 ownership.

you keep all ownership rights in your User Content. nothing in these Terms transfers ownership of your game, your art, or your bio to us.

5.2 license to vibezilla.

by submitting User Content, you grant vibezilla a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, store, modify (for formatting and editorial fit), adapt, publish, display, distribute, and create derivative works of that User Content for the purpose of operating, promoting, and improving the Service — including listing your game on the site, featuring screenshots and copy in posts and collections, sending editorial newsletters that mention you, and creating thumbnails and OG images. you also grant us the right to use your name and any public-facing brand or pseudonym you submitted, in connection with your submission.

this license continues for as long as we host your User Content. if we remove your User Content (or you ask us to and we agree to), the license ends with respect to that content, except for archival copies kept for editorial history, and except for any references in previously sent newsletters or external archives we cannot retract.

what this license does not cover. the license above is for editorial and operational use only. it does not include, and we will not without first asking you separately:

  • using your User Content as training data for any AI / machine-learning model — ours or a third party's;
  • selling, renting, syndicating, or licensing your User Content to advertisers, data brokers, or other publishers;
  • using your name, likeness, or work to endorse a paid product without your separate consent.

5.3 your representations.

by submitting User Content, you represent and warrant that:

  • you own the User Content, or you have all the rights and permissions necessary to grant the license in Section 5.2;
  • your User Content does not infringe any third party's intellectual-property, privacy, publicity, or other rights;
  • your User Content is not unlawful, defamatory, misleading, fraudulent, or obscene;
  • your User Content does not contain malware, security exploits, or other harmful code;
  • any people depicted in images you submit have consented to that depiction in the manner you've submitted it;
  • any links you submit point to content that is lawful and accurate.

5.4 indemnity for User Content.

you agree to indemnify and hold vibezilla harmless against any claim, liability, loss, damage, or cost (including reasonable legal fees) arising from your User Content or your breach of the representations in Section 5.3 — including IP claims, defamation claims, privacy claims, and any claim that your User Content caused harm to a third party. this is in addition to the general indemnity in Section 14.

6. editorial discretion.

vibezilla is curated. we may, at our sole and absolute discretion and without obligation to explain:

  • accept, reject, or ignore any submission;
  • edit submission copy, tagline, description, or thumbnail for editorial fit;
  • tag, group, recommend, or feature any game or creator;
  • delay, archive, unfeature, or remove any listing at any time;
  • decide who is and isn't a public creator on the site.

none of these decisions create any liability to you, and our exercise (or non-exercise) of editorial discretion does not waive our right to exercise it differently in the future.

7. acceptable use.

you agree not to do any of the following — directly or by helping someone else do them:

  • send spam, phishing, scams, or unsolicited bulk messages through any vibezilla surface;
  • impersonate any person, organization, or creator, or misrepresent your affiliation;
  • infringe anyone's copyright, trademark, patent, trade-secret, privacy, or publicity rights;
  • upload, link to, or distribute malware, viruses, exploits, or other harmful code;
  • harass, threaten, or target anyone with abusive content;
  • submit content that is obscene, hateful, or that promotes violence or unlawful acts;
  • submit games, profiles, or pitches involving NFTs, crypto, "play-to-earn", token gating, or any blockchain-as-the-pitch — this is also on the public no-list;
  • scrape, crawl, or harvest data from the Service except as our robots.txt permits, and never against our API or authenticated surfaces;
  • use automation, headless browsers, or load generators against any part of the Service in a way that interferes with normal operation;
  • attempt to bypass rate limits, honeypots (we use a hidden _hp field on our forms — disclosed in the Privacy Policy), sign-in, or any other access control;
  • reverse-engineer, decompile, or otherwise try to derive source from the Service except where law permits and the operator authorizes;
  • resell, sublicense, or redistribute the Service or access to the Service without our written permission;
  • use the Service in any way that violates applicable law, including export-control and sanctions laws.

we may investigate and act on suspected breaches without prior notice, including by removing content, suspending accounts, blocking IPs, and cooperating with law enforcement. we have no obligation to monitor User Content but we may do so at our discretion.

8. our content + brand.

the editorial content we write — posts, collection notes, kickers, copy, illustrations, the design system, the source code we publish, and the look and feel of the site — is owned by us or our licensors and is protected by copyright, trademark, and other laws.

"vibezilla", the vibezilla wordmark, and the zilla mark are trademarks of the operator. you may use the brand assets in our press kit as that page describes — to write about, link to, or sponsor vibezilla. you may not use the marks to imply endorsement or affiliation, to brand a competing product, or in a way that could confuse readers about what is and isn't us.

we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes — and for the editorial / journalistic / promotional purposes the press kit anticipates. we keep all rights not expressly granted.

9. third-party games + links.

most games on vibezilla are made and hosted by their creators. we embed them via iframes, link to them on itch.io / Newgrounds / neocities / personal sites, or otherwise point to third-party destinations. we are not the author, publisher, host, or operator of those games.

we curate for editorial taste — "we think the game is good and worth your time". curation is not, and is not intended to be, any of:

  • a security audit of the game's code, the studio's infrastructure, or any third-party hosting service it's served from;
  • a privacy review of what the game collects, what cookies its host sets, or where that data ends up;
  • an age-appropriateness rating, content warning, accessibility certification, or quality-assurance pass;
  • a guarantee that the game will keep working, stay free, stay online, or behave the same way tomorrow.

when you click out, embed, or otherwise interact with a third-party game, third-party site, or third-party service:

  • that destination is governed by its own terms and privacy policy, not ours;
  • any data you give it (typed text, account creation, IAP, microphone or camera access) is between you and them;
  • iframed games run inside your browser tab and inherit the security risks of any third-party host you visit directly;
  • their security, availability, and content are out of our control.

you use third-party content at your own risk. "feature on vibezilla" means "we think the game is good", not "we have audited the studio". if a third-party destination harms you, your remedy is with that third party, not with us. if you find a featured game doing something that violates these Terms or another person's rights, please email us — see Section 10 below and the parallel section in our Privacy Policy; we'll act fast.

10. respecting other people's rights.

we do our best to respect intellectual property and the rights of the people behind the games and content we feature. if you find anything on vibezilla — a screenshot, thumbnail, copy, image, link, or any other content — that you believe violates your copyright, trademark, name and likeness, privacy, publicity, or other rights, please email hi [at] vibezilla [dot] games with enough detail for us to find the content, and we'll act fast — usually within a couple of days. you don't need to file a formal legal notice to get our attention; a plain-language email is enough, and applies regardless of which country's IP regime your claim sits under.

if you'd rather use the formal United States DMCA process, the section below describes how. both routes go to the same inbox.

11. copyright + DMCA.

we respect intellectual-property rights and respond to clear notices of alleged copyright infringement. if you believe content on vibezilla — typically a thumbnail, screenshot, or copy — infringes a copyright you own or are authorized to enforce, please email hi [at] vibezilla [dot] games with a notice that includes:

  • identification of the copyrighted work you say has been infringed;
  • the URL on vibezilla where the allegedly infringing content appears, with enough detail for us to find it;
  • your contact information (name, email, address, phone);
  • a statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
  • your physical or electronic signature.

we will review and act on valid notices, and we may pass them along to the relevant submitter. if we remove content of yours that you believe was wrongly removed, you may submit a counter-notification with the equivalent information. we may terminate the accounts of repeat infringers in appropriate cases.

we have not yet registered a formal DMCA designated agent under 17 U.S.C. § 512(c)(2). until we do, the email above is the operative contact for copyright complaints. if we register a designated agent, we'll update this section.

12. disclaimer of warranty.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, INCLUDING ALL CONTENT, GAMES, EMBEDDED THIRD-PARTY GAMES, FEATURES, AND ANY DATA OBTAINED THROUGH THE SERVICE, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, RELIABILITY, AVAILABILITY, AND QUIET ENJOYMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (b) DEFECTS WILL BE CORRECTED; (c) ANY GAME, EMBED, LINK, OR THIRD-PARTY DESTINATION WILL BE AVAILABLE OR FREE OF HARMFUL COMPONENTS; (d) THE EDITORIAL CONTENT, METADATA, OR ANALYTICS DATA ON THE SITE WILL BE ACCURATE OR COMPLETE; OR (e) THE SERVICE WILL MEET YOUR EXPECTATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

in plain English: vibezilla is a free service offered without any uptime SLA. we don't promise 99.9% availability, response times, recovery objectives, or any other commercial-grade guarantee. we try to keep it up, we monitor it, we fix things when they break — but if the site is offline when you wanted to play, that is the deal.

13. limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VIBEZILLA, ITS OPERATOR, AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU UNDER ANY THEORY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • LOSS OF PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY;
  • LOSS OR CORRUPTION OF DATA;
  • BUSINESS INTERRUPTION;
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT;
  • DAMAGES ARISING FROM ANY THIRD-PARTY GAME, LINK, EMBED, OR DESTINATION;
  • DAMAGES ARISING FROM BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) ONE HUNDRED US DOLLARS (US$100) AND (b) THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS CAP APPLIES IN THE AGGREGATE ACROSS ALL CLAIMS.

THESE LIMITATIONS APPLY EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

14. indemnity.

to the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless vibezilla, its operator, and any of its affiliates, contractors, and agents from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • your use of the Service;
  • your User Content (see also Section 5.4);
  • your breach of these Terms or the Acceptable Use rules;
  • your violation of any law or third-party right;
  • any third-party site or game you reach through a link or embed on the Service.

we may, at our option, take exclusive control of the defense and settlement of any matter for which you are required to indemnify us; if we do, you agree to cooperate at your expense.

15. termination.

you may stop using the Service at any time and delete your account from your account settings (or by emailing us). we may suspend, restrict, or terminate your access to all or part of the Service — with or without notice — at our discretion, including for breach of these Terms, suspected fraud or abuse, security risk, prolonged inactivity, or where required by law.

sections that by their nature should survive termination will survive, including: 5 (User-Submitted Content), 8 (Our Content + Brand), 12 (Disclaimer), 13 (Limitation of Liability), 14 (Indemnity), 17 (Governing Law), and any payment or accrued-fee obligations.

16. changes to the service + these Terms.

the Service is a living thing. we may add, change, deprecate, or remove features at any time, including paywalled features (when those exist) and embedded games we no longer want to host. we are not liable for those changes.

we may also update these Terms from time to time. for material changes, we'll bump the "last updated" date at the top of this page and, where the change affects anyone with an account or subscription, send notice to the email on file. continuing to use the Service after a material change takes effect means you accept the updated Terms; if you don't, you can stop using the Service and delete your account.

17. governing law + venue.

these Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. you and we agree to submit to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel for any dispute not subject to a different mandatory rule of law.

if you are a consumer, nothing in this section deprives you of the protection of any mandatory consumer-protection rules of the country where you reside.

18. miscellaneous.

  • entire agreement. these Terms, together with the Privacy Policy, are the entire agreement between you and vibezilla on this subject and supersede any prior or contemporaneous agreements on the same subject.
  • severability. if any provision of these Terms is found unenforceable, the rest of the Terms remains in full force, and the unenforceable provision is enforced to the maximum extent permitted by law.
  • no waiver. our failure to enforce any provision isn't a waiver of our right to enforce it later.
  • assignment. you may not assign these Terms without our written consent. we may assign these Terms (e.g. in a merger, acquisition, or sale) without restriction.
  • force majeure. we are not liable for any failure or delay caused by circumstances beyond our reasonable control (acts of God, war, civil unrest, labor disputes, government actions, internet or power outages, cyberattacks, infrastructure failures, pandemics, and the like).
  • no third-party beneficiaries. these Terms do not create any third-party beneficiary rights.
  • headings. headings are for convenience and have no legal effect.
  • language. these Terms are written in English. any translation is for convenience only; in case of conflict, the English version controls.

19. contact.

questions, complaints, copyright notices, legal process: hi [at] vibezilla [dot] games . we read every email. we always reply.
